Thane: The Motor Accident Claims Tribunal (MACT) directed MSRTC to pay Rs 36.3 lakh to the family of a 44-year-old man killed in a collision with an ST bus in 2020.Member RV Mohite delivered the judgment on Jan 1, holding both the bus driver and the deceased motorcyclist responsible for the accident, with liability split 80-20. The incident occurred on Dec 9, 2020, when the victim rode his motorcycle on the Kalyan-Murbad road. An ST bus travelling from opposite direction collided with his bike. He sustained injuries and died during treatment.The victim’s widow, two daughters, and elderly parents sought compensation, stating he was a permanent employee at a freight service company earning over Rs 26,000 monthly. The tribunal noted there was “absolutely no evidence” the deceased was overtaking a truck, or that the bus driver gave light signals and applied brakes, as “there were no brake marks at the spot.”“The negligence of deceased is assessed to the extent of 20% and the negligence of driver of ST bus is assessed to the extent of 80%,” the judgment stated. MSRTC must deposit the amount with 9% annual interest from March 2021. Significant portions for the widow and daughters will be placed in three-year fixed deposits.
