Karnataka high court quashes charges against BJP MLA but denies pre-arrest bail | Bengaluru News
Bengaluru: The high court Friday quashed the order permitting invocation of Karnataka Control of Organised Crime Act, 2000 (KCOCA) against BA Basavaraj, BJP MLA from KR Pura constituency, in rowdy-sheeter Shivaprakash murder case. However, the court rejected his plea for anticipatory bail in the case.Basavaraja, arraigned as accused number 5, had challenged the Aug 12 order granting CID permission to invoke KCOCA against him. Justice S Sunil Dutt Yadav said the legal requirement of organised crime, which involves ‘continuing unlawful activity’ as contemplated under Sections 2(1)(d) and 2(1)(e) of KCOCA, was not satisfied in this case. On the issue of anticipatory bail, Justrice Yadav cited the exceptional nature of exercising power under Article 226 of the Constitution and found prima facie force in the additional state public prosecutor’s contention.
